PREVENTION OF THE RECOVERY FOR DAMAGES TO DISTRICT WATERLINES


The Board of Directors of Chisholm Trail Special Utility District has stated that the District will not bear
the cost of repairing waterlines of the District that are damaged as a result of the action of others.

The owner of the property is responsible for informing all contractors, other utility companies or anyone who will be digging on your property, of the location of the waterline. Advance notice to our office of such construction will allow us time to spot our waterline. Please call 254-793-3103 as early as possible but at least 72 hours in advance, before excavation begins.

Accordingly, the Board of Directors has adopted a policy that if a waterline of the District is cut, broken or otherwise damaged by others, the person responsible shall be liable for the repair and replacement costs required to place the waterline back in service. Anyone responsible for damaging a waterline of the District will be required to pay all repair and replacement costs incurred by the District for parts and labor. Labor costs will be one and one-half times the regular labor costs of the District's employees for work on holidays and weekends and for the work performed outside normal working hours. In addition, the person responsible will be required to pay for any water lost (as determined in the reasonable judgment of the District) as a result of the damage and a $30.00 service trip fee for each required trip to the site of the damage.

The Board of Directors of the District requests your cooperation in helping prevent damage to the District's water facilities. It is especially important that the District be notified as soon as a line break or other damage occurs so that the problem can be corrected promptly. We also recognize that many times, damages to a waterline are caused by people other than customers of the District. Your vigilance in identifying and notifying the District of people responsible for damaging any of the District's facilities will be in the best interest of the District's customers.
